Wheatland man not to face jail time in case of mistreating animals

Fargo, ND (WDAY TV) - The Wheatland man whose 170 dogs were seized will not be going to jail.

Monday, 51-year-old Darcy Smith didn't show up for his sentencing telling his lawyer he had problems with his furnace.

Back in July, Cass County authorities seized nearly 170 dogs from his rural property.

They were living in cramped and dirty conditions; with matted hair and health issues.

Instead of jail time, Smith will spend two years on supervised probation; during that time, he cannot own any dogs.

Leah Viste/Cass County Asst. State Attorney: “This was a case of neglect, which is unacceptable; however Mr. Smith was extremely cooperative throughout the course of this. One of the primary things is is that he did forfeit his animals without a contested proceeding."

Smith also has to pay a $2,000fine and undergo a mental diagnostic assessment, as the state says he could have issues with hoarding.
