Mandan man gets 3 years for aggravated assault

MANDAN, N.D. (AP) — A Mandan man convicted of aggravated assault for a punch at a house party in which a Bismarck man died has been ordered to serve three years in prison.

MANDAN, N.D. (AP) — A Mandan man convicted of aggravated assault for a punch at a house party in which a Bismarck man died has been ordered to serve three years in prison.

The Bismarck Tribune reports that South Central District Judge Cynthia Feland sentenced 24-year-old Colten Towry to five years in prison with two years suspended.

Towry was accused of punching 30-year-old Derek Oshkeshequoam at the October 2012 party while attempting to break up a fight between Oshkeshequoam and another man. Oshkeshequoam, of Bismarck, fell and hit his head on pavement. He died days later at a hospital.

Towry was tried for manslaughter but convicted on the lesser charge.

Two other men have pleaded guilty to reckless endangerment for failing to get Oshkeshequoam medical care.
