A Cavalier man is dead after he was ejected from the vehicle he was riding in when it struck a pickup near Cavalier.

55-year-old Bartolo Cano died at the Pembina County Memorial Hospital shortly after the crash, which happened at around 11 a.m. Wednesday.

Cano was a passenger in a pickup truck driven by 43-year-old Arnoldo Garza Suarez of Glasston, ND. Charges for Suarez are pending, according to the Highway Patrol.

23-year-old Grant Emerson of Cavalier was injured in the accident.

Both Emerson and Garza Suarez were transported to the Pembina County hospital, and both later transferred to Altru Hospital in Grand Forks.

All three men were not wearing seat belts.

The crash happened as the Highway Patrol says Suarez failed to yield at an uncontrolled gravel road intersection about three miles southeast of Cavalier.

Garza Suarez struck Emerson's vehicle at the driver's side front tire. Both vehicles slid across the intersection and came to rest in the southwest ditch. Suarez and Cano were both ejected from their vehicle.

The Highway Patrol says alcohol was not a factor in the crash. It remains under investigation.
