Valley City man charged with fourth DUI

Fargo, ND (WDAY TV) - A Valley City Man is facing his 4th driving charge.

Fargo, ND (WDAY TV) - A Valley City Man is facing his 4th driving charge.

And under a new law that took effect in July, he's the 20th person in Cass County to be charged with a "Felony" DUI.

DUI becomes a felony when a person has 3 prior DUI's, since July of 1981.

Fines and in many cases, jail time, are doubling under the new laws..

The cities first felony DUI offense would begin with a routine traffic stop here at the intersection of Main Avenue and 9th Street East, it would end with a short pursuit, four to five blocks.

Mike Reitan- West Fargo PD, Assistant Chief: "The individual initially pulled to the site of the road and sped off."

The driver, 27- year old Anthony Smith, of Valley City.

Upon fleeing, he wouldn't make it far.

Reitan: "Drove into a private parking lot and damaged the two front tires of his vehicle."

Smith's car stalled at Trinity Containr, inebriated and under arrest.

Reitan: "He was arrested for driving under the influence, driving under suspension and eluding."

Smith's charges come with a hefty penalty.

Reitan: "He is required to be sentenced to a year and one day in prison for the DUI offense. A portion of that sentence may be suspended if he under goes alcohol treatment."
