Fargo, ND (WDAY TV) - A 20-year-old from Kindred is being charged in a fatal car accident that took the life a 61-year-old man from Casselton.
New details from the August 1st crash show Nicholas Milbrandt was driving at high speeds and using his cell phone when he rear-ended the car in front of him.
A criminal summons came out of Cass County Court today for Nicholas Milbrandt. The 20-year-old is now charged with manslaughter and reckless endangerment.
The felony charges come after a deadly two-vehicle accident just outside of West Fargo back on the morning of August 1st.
Authorities say Milbrant was driving on I-94 when he rear ended 61-year-old Royce Rodacker whose pick-up crashed into the median and rolled.
Rodacker was pronounced dead at the scene.
New court documents say Milbrant was "driving at a high rate of speed" while "sending and receiving text messages."
We contacted Milbrant's family who did not want to comment, and stopped by Rodacker's family's house in Casselton, but no one was home.
The Cass County State attorney’s office says charges took this long to come down because they were waiting for the investigation and accident reconstruction to wrap up.
Milbrant's arraignment is October 11th. If convicted of both charges, he faces up to 15 years in prison.
