Jury finds Bagola guilty of murdering two siblings on Spirit Lake reservation

FARGO – A federal jury Monday afternoon convicted Valentino “Tino” Bagola of two counts of murder for the stabbing deaths of two children on the Spirit Lake reservation.

FARGO – A federal jury Monday afternoon convicted Valentino “Tino” Bagola of two counts of murder for the stabbing deaths of two children on the Spirit Lake reservation.

The jury returned its verdict in U.S. District Court around 1 p.m., ending 13 or 14 hours of deliberation that began Thursday.

Bagola, 20, faces a mandatory life sentence for his conviction on two counts of felony murder. Jurors did not find Bagola guilty of premeditated murder.

“We’re very pleased with the verdict,” said Chris Myers, the lead prosecutor in the case. “I think this was a very attentive and conscientious jury who looked at the evidence and saw it as we did.”

Bagola was convicted of murdering Destiny Shaw, 9, and her 6-year-old brother, Travis DuBois, Jr. The children were found dead in a bedroom of their home in St. Michael on May 21, 2011.

In convicting Bagola, jurors rejected what prosecutors said was a false confession from their father, Travis DuBois, Sr., who had been binge drinking in the home in the days leading up to the discovery of the bodies by their mother.

District Judge Ralph Erickson set sentencing for December. Bagola remains in custody.

Bagola’s lead defense lawyer, Christopher Lancaster, declined comment after the verdict came in, so it was not immediately clear whether Bagola will appeal the convictions.
