FARGO – A Fargo scrap metal dealer must pay a fine and spend five years on probation after not filing a tax return.

Hamzo Omerovic pleaded guilty on March 25 in U.S. District Court to willfully failing to file an income tax return for calendar year 2006, a Class A misdemeanor.

On Monday, federal Judge Karen Klein sentenced Omerovic to five years of probation and ordered him to pay restitution to the United States as determined pursuant to a civil tax audit for tax years 2006, 2007, and 2008.

Omerovic, 27, a self-employed scrap metal dealer, purchased and obtained scrap metal in Fargo and the surrounding area in 2006. He then sold the metal to a number of other dealers in North Dakota and Minnesota.

An Internal Revenue Service investigation showed that Omerovic’s gross receipts for the year totaled more than $152,000, with an estimated tax loss of more than $30,000.

“Failure to file tax returns is a serious crime which can result in prosecutions like this one,” U.S. Attorney Timothy Q. Purdon said in a news release. “Those who criminally evade their duty to file and pay federal taxes unfairly shift their tax burden on to the backs of hard-working Americans who comply with the tax laws.”
