Fargo, ND (WDAY TV)-- A Cass County Jail Sergeant, who pepper sprayed an inmate, has resigned after a report found he used excessive force.
The incident happened March 18th.
An internal investigation found Sergeant Lyndon Worden sprayed an inmate in the hand and face while the inmate was strapped to a restraint chair.
Worden's Lieutenant, captain, and chief deputy all recommended he be fired.
Worden resigned by email May 9th, hours before he was supposed to attend a termination meeting with Sheriff Paul Laney.
Warden says Laney's report didn't tell the whole story and he used this incident as an excuse to get rid of him.
Laney says that's a cheap shot and says the pepper spray incident alone led to his firing.
Jail staff says the termination was justifiable.
"I think it's what needed to be done. certainly to protect, to demonstrate we're willing to protect our jail population. they are entrusted to our care, and we have a responsibility to not put the county in a position of any kind of liability."
Warden has spent 24 years with the department.
