Wheatland, ND (WDAY TV)-- The man whose 170 dogs were seized from his Cass County farmstead will not be getting them back.

Darcy Smith of Wheatland is legally giving the dogs up.

The 51-year-old has said he would fight to get them back, but today, Smith was a no show in court.

Instead, he signed the dogs and their offspring over to the Cass County Sheriff's department.

It will work with area rescue groups like 4 Luv of Dog Rescue to get these animals into good homes.

Smith could still face charges.
