Stenehjem: North Dakota University System Foundation broke open records law

BISMARCK, N.D. (AP) — Attorney General Wayne Stenehjem says a nonprofit arm of the North Dakota University System broke the law by denying a copy of its revenues and expenditures.

BISMARCK, N.D. (AP) — Attorney General Wayne Stenehjem says a nonprofit arm of the North Dakota University System broke the law by denying a copy of its revenues and expenditures.

In a written opinion Tuesday, Stenehjem says the North Dakota University System Foundation is subject to the state's open records law and must disclose its records.

The group had argued that it was not subject to the state's open records law because it is not a public entity as defined under state law. The group says it is a private, nonprofit foundation funded by private contributions.

Stenehjem's opinion says the foundation has no staff and relies on the university system for its operation, administration and legal counsel.
