Federal prosecutors are asking for the notes on the Alfonso Rodriguez Jr. case

Fargo, ND (WDAY TV)-- Federal prosecutors are asking defense attorneys to turn over notes in the case of Alfonso Rodriguez Jr. and say their refusal is meant to prolong the appeal.

Fargo, ND (WDAY TV)-- Federal prosecutors are asking defense attorneys to turn over notes in the case of Alfonso Rodriguez Jr. and say their refusal is meant to prolong the appeal.

Rodriguez was sentenced to death for raping, beating and killing UND student Dru Sjodin in 2003.

Defense attorneys filed a motion in 2011, considered the last step in the appeals process, claiming that Rodriguez is mentally disabled.

Prosecutors want notes from mental health professionals who have examined Rodriguez.
