FARGO, N.D. (AP) — Prosecutors want to seize a Hummer vehicle a West Fargo landlord used to run over a former tenant — an incident that landed 75-year-old Alois Vetter in prison.

FARGO, N.D. (AP) — Prosecutors want to seize a Hummer vehicle a West Fargo landlord used to run over a former tenant — an incident that landed 75-year-old Alois Vetter in prison.

Vetter was sentenced to two years behind bars in the assault and reckless endangerment case because jurors decided the Hummer constituted a dangerous weapon.

Defense attorney Richard Edinger says the state should have taken the $27,000 Hummer in April 2011, when prosecutors decided to treat the vehicle as a dangerous weapon. The Forum newspaper reports that a judge will rule later.

Vetter's October 2011 conviction was upheld by the state Supreme Court in January.
