North Dakota appeals court upholds woman's conviction, sentence

FARGO, N.D. (AP) — A federal appeals court has upheld the conviction and sentence of a North Dakota woman convicted of embezzling from the Spirit Lake Tribe.

FARGO, N.D. (AP) — A federal appeals court has upheld the conviction and sentence of a North Dakota woman convicted of embezzling from the Spirit Lake Tribe.

Patricia Robertson was convicted in October 2011 on theft and embezzlement charges. She was sentenced to probation and ordered to pay back nearly $5,500.

Robertson argued in her appeal that the conviction should be overturned because of errors during jury instructions, and the sentence was not valid because of a special condition prohibiting her from consuming alcohol.

The 8th U.S. Circuit Court of Appeals denied both claims in a ruling released earlier this week.
