Minnesota (WDAY TV) -- A Minnesota man has now been charged with criminal vehicular homicide, after his SUV crashed through thin ice and his baby daughter drowned.
Authorities say 41 year old Jonathan Markle had a BAC of 0.13 percent two hours after the accident on Lake Minnetonka. Markle, his wife and their 2 year old daughter escaped, but his 8 month old daughter Tabitha was strapped in the backseat and died.
At a hearing on Friday Markle's attorney says the system can't punish Markle any more than he has been punished.
