Judge upholds manslaughter charge in June accident death

Long Prairie, MN (WDAY TV) - A judge has upheld a manslaughter charge against a truck driver involved in a fatal crash in Fargo.
56-year-old James Toner, of Long Prairie, pleaded not guilty to manslaughter and aggravated reckless endangerment. He faces 10 years in prison.
Toner was making a right hand turn when a trailing motorcycle hit the rig back in June. 29-year-old Jason Viestenz died. His 10 year old son was injured.
His attorney argued the level of the charge was too high. The judge disagreed.
