FARGO – The former North Dakota State University linebacker who initially pleaded not guilty to an indecent exposure charge is set to change his plea in February.
Brandon Jemison was scheduled to appear in Cass County District Court on Wednesday, but his misdemeanor dispositional conference was canceled.
Assistant State’s Attorney Renata Olafson Selzer said Jemison has a change of plea hearing scheduled for Feb. 19, but Selzer would not comment on details of the new plea.
Jemison is accused of exposing his genitals in the presence of a woman and children July 27 while sitting on a bench outside West Acres mall, according to the charge filed Aug. 24. He was dismissed from the Bison football team for what coach Craig Bohl said was a violation of team rules.
Jemison’s father previously told The Forum that the incident was a “wardrobe malfunction,” and that Jemison realized he had a hole in his shorts and moved to a more discreet area to try to fix it.
The Class A misdemeanor charge carries a maximum penalty of one year in jail and a $2,000 fine. If convicted, Jemison also could be required to register as a sex offender for 15 years.
