North Dakota bar owners start enforcing the smoking ban

Fargo, ND (WDAY TV) -- Bar owners in North Dakota still have many questions about how the new smoking ban will be enforced.

Fargo, ND (WDAY TV) -- Bar owners in North Dakota still have many questions about how the new smoking ban will be enforced.

The state-wide ban easily passed with 66% of the vote on Tuesday and it takes effect December sixth. The Department of Health will enforce the law through anonymous complaints.

Fargo Cass Public Health says enforcement will be a three-strike process.

Robyn Litke Sall with the Fargo Cass Public Health says, "if there is a third offense from the same business at that point we would work with local law enforcement to come up with a solution and possibly a penalty."
