Moorhead, MN (WDAY TV) -- Sixteen year-old Kullen Carney has been charged in Clay County after a rollover crash killed his Moorhead High School classmate.

Carney is charged with two counts of criminal vehicular homicide, reckless driving and speeding, after being the driver in the August 9th accident.

The crash killed 17 year old Austin Wagar and injured 16-year-old Brendan Daly.

Court documents say he was driving 88 miles per hour in a 55 zone when a car pulled out in front of him, causing him to lose control. His car flipped then caught fire.

Prosecutors say Carney had prescription drugs and marijuana in his system.

Clay County Attorney, Brian Melton, says, "young kids need to know, I mean, when they're getting together in cars and whether it's alcohol or drugs or even just texting, all those kinds of things, when you get into a vehicle you need to be smart about what you're doing and make sure you're being responsible. If you're not unfortunately some things can happen and people can get hurt."

Carney will receive a juvenile and adult sentence if he's found guilty, under the Extended Jurisdiction Juvenile law.
