Moorhead, MN (WDAY TV) -- A convicted rapist who now faces new charges of sexual assault, is free tonight after posting bail.
And it has the prosecutor upset and concerned, after the man got out on a 10th the amount of money prosecutors were asking for. 46 year old Richard Halaand is charged with gross sexual assault. He's scheduled to be in court next Friday, but free until then.
This is where the alleged sexual assault happened in the early morning hours of September 6th. And with this person free tonight the prosecutor is concerned there could be a repeat.
Pam Harris/Prosecuting Attorney: "I would think the public is in danger anytime a convicted sex offender is out on the loose."
Prosecuting attorney Pam Harris has another major concern. She says Halaand has a substantial amount of money, more than enough to disappear.
Judge Lisa Borgen set bail at 500-thousand dollars, or 100-thousand with conditions.
"I don't agree with it if I agreed with 100-thousand that's what I would have requested I wanted a million."
Executive Director at Rape and Abuse Greg Diehl can't comment on this case,
but says the legal system is often too lenient on how it handles people accused or convicted of crimes against people.
He says a sentence or punishment often has a time limit, but the damage to a victim is there forever.
Greg Diel: "you can help them to what we sometimes call going to victim to survivor but it's always there it's always apart of them."
Harris gives credit to Minnesota, saying its sex crime penalties have teeth. But felt in this case Haaland got out on bail easier than he should have.
