Fargo, ND (WDAY TV) - A judge says a custody investigator must testify at the criminal trial of a Fargo surgeon accused of drugging and raping his wife. Judge Douglas Herman says it sets a terrible precedent, but it's the conclusion his legal research led him to.

Fargo attorney Michael Gjesdahl was appointed a custody investigator in the divorce case of Doctor Jon Norberg and his wife Alonna Norberg. Prosecutors want Gjesdahl to testify at the criminal trial about statements Dr. Norberg allegedly made during the custody investigation regarding the number of times he had sex with his wife while she was on propofol.

Gjesdahl says this ruling puts him in an un-neutral role in the custody case.
