(WDAY TV) -- Federal prosecutors say they want their own experts to interview the man sentenced to death for kidnapping and killing UND Student Dru Sjodin.

Alfonso Rodriguez Junior of Crookston is on death row in an Indiana prison.

U.S. attorneys are working to answer a 300-page habeas corpus appeal filed in October asking for a new trial or sentencing hearing.

Prosecutors today filed a motion asking for an independent psychiatric exam of Rodriguez because of his claim that his attorney should've used the insanity defense. And that he's mentally retarded.

Defense attorneys have not filed their response.
