ND Supreme Court hears appeal of prop tax lawsuit

BISMARCK, N.D. (AP) — North Dakota's Supreme Court is hearing an appeal of a lawsuit over the state's debate about whether to abolish property taxes.

BISMARCK, N.D. (AP) — North Dakota's Supreme Court is hearing an appeal of a lawsuit over the state's debate about whether to abolish property taxes.

The debate will be resolved a week from Tuesday, when voters decide the fate of Measure 2. It is a constitutional amendment that would prohibit property taxes.

The amendment's supporters claim Tax Commissioner Cory Fong and other officials are illegally spending public money to oppose the measure.

They're arguing they should be able to enforce state laws against illegal campaigning if local prosecutors won't do it.

A judge threw out the lawsuit in April. Bruce Romanick said backers of Measure 2 didn't have legal standing to sue to enforce the law themselves.

Opponents of Measure 2 say they're not using taxpayer money to fight the idea.
