WAHPETON, N.D. (AP) — A 35-year-old Wahpeton man charged in a fatal motorcycle crash last fall has pleaded guilty to negligent homicide.
The Daily News reports (http://bit.ly/wFiOgr ) that David Berning reached a plea agreement with prosecutors under which they will seek no more than a one-year sentence.
Berning was charged after a Sept. 5 motorcycle collision that resulted in the death of his passenger, 25-year-old Mallie Breuer of Mooreton. Authorities alleged that he had been drinking alcohol before driving.
Authorities say Berning lost control of his motorcycle after striking the rear wheel of another motorcycle he was traveling with on Interstate 29 in Richland County, throwing Breuer into the ditch. She died at the scene.
