Police arrest DUI suspect sleeping in drive through lane at Wendy's

FARGO – A late-night customer who ordered a burger at Wendy’s got himself into a pickle with police when he passed out in the drive through, Fargo police say.

Lt. Joel Vettel says officers responding at about 11 p.m. Monday to the fast-food restaurant at 4430 18th Ave. S. found the man slumped over the steering wheel with his foot on the brake and the silver Ford Explorer still in gear.

The 36-year-old apparently had ordered his food - a hamburger with pickles - and then fell asleep as he was waiting for the vehicle in front of him to go through, Vettel said.

When the man woke up, he allegedly told police that his friend had been driving, but when the officer asked him what his friend had ordered to eat, he admitted that no one else had been in the vehicle, Vettel said.

Police arrested Shane G. Smith of Fargo on suspicion of drunken driving and took him to the Cass County Jail.
