In June, people in North Dakota will vote on Measure 2 in an attempt to abolish all property taxes. Measure 2 advocates are going to the court asking several elected officials be penalized for swaying public opinion on the issue.

The attorney for Empower the Taxpayer group says today they filed a complaint against tax commissioner Cory Fong, and several other public officials for violating the Corrupt Practices Law. The group alleges they are using public tax dollars for political reasons and giving false information to voters on the Measure 2 issue.

Lynn Boughe – Attorney for Empower the Taxpayer: "This law, corrupt practices law applies to anyone running as well as any public officials, we hope that one of the ripple effects is that these individuals would read the law and realize they're not supposed to be taking sides, and especially not on the government dime."

Opponents of the measure say the group is instead losing in the court of public opinion.

Andy Peterson - Chamber of Commerce: "It's a use of intimidation and threats and really half-truths, we think this injunction they are trying to file will be baseless and will be dismissed."

The attorney for the Empower the Taxpayer group says they are hoping to get an injunction before election time.
