Agency says it can't act in ND trench collapse

DICKINSON, N.D. (AP) — A federal agency says it can't intervene in a case where a man died in a trench collapse because the man wasn't working for the company that built the trench.

DICKINSON, N.D. (AP) — A federal agency says it can't intervene in a case where a man died in a trench collapse because the man wasn't working for the company that built the trench.

Casimiro Medina had been working on water and sewer piping for a concrete construction contractor when the collapse happened in northwest Dickinson in December.

The 39-year-old Medina jumped into the trench to attempt to save another man, and was buried in a second trench collapse.

Occupational Safety and Health Administration assistant director Eric Brooks tells The Dickinson Press (http://bit.ly/A8Xvk4 ) a company called Backyard Paradise LLC of Salt Lake City was in charge of the trench digging.

Brooks says because Medina didn't work for Backyard Paradise, the federal agency doesn't have jurisdiction to file a complaint on Medina's behalf.
