FARGO, N.D. (AP) — A Fort Totten man has been found guilty by a federal jury of embezzling from the Spirit Lake tribe, and the mother of his children has pleaded guilty to the crime.

Thirty-eight-year-old Justin Yankton and 29-year-old Brooke Black lived with their children in Fort Totten. U.S. Attorney Timothy Purdon says Black omitted the name and income of Yankton on applications for home heating assistance.

Purdon says the residence received assistance for about 2 ½ years, and at times Yankton in his capacity as tribal secretary-treasurer would order fuel to be delivered.

Yankton faces up to five years in prison and Black up to a year behind bars when they're sentenced April 23 in Fargo.
