A West Fargo Cop accused of disorderly conduct has resigned today, effective immediately. West Fargo Police Officer Allen Schmidt was arrested in Fargo on December 14th after allegedly hitting his girlfriend in the face.

Now, at the request of the West Fargo Police department, which was in the middle of an internal investigation, Schmidt handed in his resignation this morning.

Schmidt was originally charged with simple assault, but that was later dropped by the State's Attorney’s Office to disorderly conduct. Police say he got into an argument with his girlfriend Sheila Windt that became physical. During that same night, Schmidt also allegedly used racist remarks and became upset after Windt was talking to a black male.

The West Fargo Police Chief says the decision to resign was the best course of action Schmidt could take.

Arland Rasmussen – West Fargo Police Chief: “Al Schmidt was and is an excellent officer, but the things that we do on or off duty to attract attention, especially the negative ones, are sometimes what sticks in people's minds.”

Shelia Windt was also charged with disorderly conduct, but on Wednesday the state moved to dismiss those charges. Schmidt is scheduled to be in court next on March 6th for a dispositional conference.
