(WDAY TV) - The NCAA says a lawsuit sparked by the UND Fighting Sioux nickname controversy should be thrown out of federal court.

The NCAA says a lawsuit sparked by the UND Fighting Sioux nickname controversy should be thrown out of federal court.

The suit was filed by members of the Spirit Lake and Standing Rock Sioux tribes. It seeks at least $10 million from the NCAA and a reversal of its policy banning use of American Indian imagery.

The North Dakota Legislature agreed to repeal a law requiring UND to keep the nickname and a logo. The motion filed by the NCAA says the tribes lack standing to bring the lawsuit and says their claims are not supported by facts.
