FORT TOTTEN, N.D. (AP) — Spirit Lake tribal members who support the University of North Dakota's Fighting Sioux nickname say they plan to proceed with a federal lawsuit.
The Legislature last week overturned a mandate that UND keep the nickname that the NCAA finds offensive, clearing the way for it to be retired.
WDAZ-TV reports (http://bit.ly/v8P4NA) that members of the tribally backed Committee for Understanding and Respect on the Spirit Lake Reservation say they won't be deterred from their lawsuit against the NCAA. The Spirit Lake supporters believe threatened sanctions against UND by the NCAA violate religious rights of Sioux tribes.
A state judge in 2009 threw out a similar lawsuit.
