Crookston, ND (WDAY TV) - The prosecution rests in the murder trial of Thomas Fairbanks. They called around 50 witnesses since testimony began on August 17th.

Crookston, ND (WDAY TV) - The prosecution rests in the murder trial of Thomas Fairbanks. They called around 50 witnesses since testimony began on August 17th.

Fairbanks faces a charge of first-degree murder in the shooting of Mahnomen County Sheriff's Deputy Christopher Dewey. If convicted he could face life in prison without parole.

Fairbanks' defense attorneys have acknowledged he shot Dewey, but argue he was too intoxicated to form criminal intent.
