Murder Trial: Prosecution and defense argue over use of weapons expert

Crookston, Minn. (WDAY TV) - A day off for the jury in the Thomas Fairbanks trial in Crookston. The defense and prosecution argued in front of the judge over the use of a weapons expert.

The defense wants the expert to testy how easily the trigger of a certain semi-automatic handgun can be pulled. They claim Fairbanks was too intoxicated to form the intent for first degree murder in the death of Mahnomen deputy Chris Dewey.

The judge will rule on the testimony tomorrow morning before the jury returns for more prosecution witnesses.
