Fargo, ND (WDAY TV) - The defense team is now in full swing, trying to clear the name of Gene Kirkpatrick. Kirkpatrick is accused of hiring a hitman to kill his son in law, Fargo dentist Phillip Gattuso.

For the first time, Kirkpatrick showed some emotion during the trial to the cameras. The defense called Dr. David Tiller, psychologist from Oklahoma.

He told juror's that Kirkpatrick suffered from "complex grief" from the loss of his daughter and lost custody of his granddaughter, also Gattuso's daughter, Kennedy. Because of that, Tiller said Kirkpatrick likely talked to everyone about his "grief" including convicted killer Michael Nakvinda who was a handy man for Kirkpatrick and may have expressed frustrations with Gattuso, but never said "go kill him".

Prosecutors also questioned Jeff Williams, Kirkpatrick's son-in-law about hearing Kirkpatrick and Nakvinda talk about Gattuso. New tonight at 6, more witnesses will take the stand for the defense team.
