We spoke with the 73-year old driver, Alois Vetter. He declined to go on camera, but says he felt threatened by the Hemphill. Vetter says the incident was an accident. Vetter says he had been trying to kick Hemphill out for not paying rent.

SGT. GREG WARREN - West Fargo Police: “We know Mr. Vetter very well and we know that things were not probably the best between renter and rentee. We are just trying to figure out what caused it to go to the next level.”

Police say they expect to send the case to the states attorney's office to file possible charges.
