Emmer: Will withdraw frivolous recount challenges

ST. PAUL, Minn. (AP) — Republican Tom Emmer says he'll withdraw ballot challenges deemed frivolous to speed up the recount of the Minnesota governor's race, but he's made no decision on a possible lawsuit.

ST. PAUL, Minn. (AP) — Republican Tom Emmer says he'll withdraw ballot challenges deemed frivolous to speed up the recount of the Minnesota governor's race, but he's made no decision on a possible lawsuit.

Emmer trailed Democrat Mark Dayton by nearly 9,000 votes going into the recount, and has been criticized for filing thousands of ballot challenges that local officials say are unfounded.

Emmer says he's not "currently planning" a lawsuit over the result. But at a news conference in St. Paul, he says the Minnesota Supreme Court has to explain why it rejected his request to make sure election officials properly followed a process called reconciliation.

That calls for officials to make sure the number of voters matches the number of ballots. Emmer argues the law wasn't properly applied.
