BISMARCK, N.D. (AP) — The attorney for a Morton County teen charged with manslaughter in a fatal crash in Bismarck says she's not to blame.
The 16-year-old girl was driving the car that police say collided with a motorcycle in July, killing 34-year-old Cody Jacobs.
Authorities have not identified the girl. Juvenile court proceedings are not open to the public.
Her attorney, Dick Baer, told the Bismarck Tribune that Jacobs was at fault in the crash. He cited a police report showing Jacobs' motorcycle hit the front of the girl's car and a toxicology report showing Jacobs blood-alcohol level was .08 — the legal limit — more than an hour after the crash.
The prosecutor declined to comment on the reports, saying the evidence will be presented in court.
Jacobs' family declined to comment.
