55-year old Charles McCarthy was sentenced to five days, time which he's already served. Two other charges were dismissed.
McCarthy was hauling a load of "wet cake," a corn byproduct, from an ethanol plant near Casselton, to his farm on November 16th when the sludge began leaking on I-94.
The icy conditions caused a two-vehicle crash and broke the arm of a 3-year-old and the ankle of a 73-year-old woman.
