MOORHEAD, Minn. (AP) — A North Dakota Highway Patrol trooper accused of assaulting his wife at their Minnesota home wants a speedy trial.
Prosecutors want to delay the Tuesday start of Michael Polomny's trial because a police officer who will testify is on a previously scheduled leave through that day.
Polomny's attorney is opposing the delay, saying a no-contact order involving Polomny and his family is creating a financial strain and other hardships for the family.
The 40-year-old Polomny is accused of pushing, kicking and punching his wife while she held their 3-month-old son in June, at their home in Moorhead, Minn. Polomny is charged with misdemeanor domestic assault and three gross misdemeanor charges of child endangerment.
Polomny was fired from the Highway Patrol earlier this month. He plans to appeal.
