Court denies appeal of repeat ND drunken driver

BISMARCK, N.D. (AP) — The North Dakota Supreme Court has rejected the appeal of a Mandan man with at least 15 drunken driving convictions since 1991.

BISMARCK, N.D. (AP) — The North Dakota Supreme Court has rejected the appeal of a Mandan man with at least 15 drunken driving convictions since 1991.

Craig Irwin was charged in June 2007 in Burleigh County with his fourth DUI in seven years. He was arrested for DUI in Morton County two weeks later and charged with a fifth DUI in seven years, which increased the penalty.

Irwin argued later that the fifth charge was improper because he had not yet been convicted in Burleigh County, and he asked to withdraw his guilty plea.

The Supreme Court upheld a judge's decision to deny Irwin's motion.
