Thomas Fairbanks is accused of attempted murder, among other charges for shooting and seriously wounding Deputy Chris Dewey last year.

Lawyers for Fairbanks told a judge Tuesday that he can't get a fair trial in Mahnomen. Prosecutors agreed. The judge granted the request to move the trial and selected Bemidji. It'll get underway May third.

A second suspect, Daniel Vernier, admitted last fall to being an accomplice in the shooting and got two years in prison. He'll testify against Fairbanks in exchange for the plea deal.
