Baseball bat beating suspect sentenced
WAHPETON, N.D. (AP) - A Wahpeton man accused of beating his younger brother with a baseball bat has pleaded guilty to aggravated assault with a deadly weapon and been sentenced to jail.
WAHPETON, N.D. (AP) - A Wahpeton man accused of beating his younger brother with a baseball bat has pleaded guilty to aggravated assault with a deadly weapon and been sentenced to jail.
Authorities say 28-year-old Daniel Pelzl attacked his brother, Justin, last Aug. 23, hitting him in the head, ribs and stomach after a lingering dispute over deleted computer files.
Southeast District Judge Richard Grosz at one point described Pelzl as "a ticking time bomb." Pelzl's attorney, Mark Meyer, said there was "not a valid defense to be made."
Grosz sentenced Pelzl to one year and 164 days in jail with credit for 164 days already served, meaning he will spend the next year in jail.
Pelzl will then be on five years of supervised probation. He also is required to go through anger management counseling and a chemical dependency evaluation, and to regularly visit a psychiatrist.
