FARGO, N.D. (AP) — The lawyer for a Gilby bank teller who was robbed at gunpoint says the state workers compensation agency should not have denied his client's claim for an anxiety disorder.
Bank officials filed the claim for 56-year-old Edith Johnson after she was diagnosed with post-traumatic stress disorder from the May 26 robbery. It was the third robbery in Johnson's tenure at the bank.
Workforce Safety and Insurance officials said in a letter to Johnson that state law does not cover a "mental injury arising from a mental stimulus."
Her attorney, Bismarck's Tom Dickson, says the exclusion is meant to apply to normal stress from performing everyday tasks at work. He is appealing the ruling.
