Fargo, ND (WDAY TV) - The 6th child sex abuse case against a former teacher at Shanley High School is now filed. This after a Fargo man came forward saying he was assaulted on a school sponsored trip in the 70's, when he was 14.
The suit blames Raimond Rose, the Fargo Diocese, Shanley, and the Christian Brothers of the Midwest province which runs Shanley and employs Rose.
The complaint made by the now 47-year old David Gaffaney charges that the three Catholic institutions committed negligence and fraud because they represented to students and families that Rose was safe, when they knew he had sexually abused at least one boy before coming to Shanley.
Gaffany's Attorney Patrick Noaker says the goal of this case is to stop Rose from harming anyone else and to get money for treating Gaffany's drug and alcohol abuse and other issues he says stem from his interaction with Rose.
The cleric has worked in North Dakota, Minnesota, Wisconsin and California, and faces accusations of molesting children in each one of them. Two cases were settled in California.
Noaker believes Rose is currently living in a Christian Brothers residence near an all boy’s catholic high school in Chicago. We know that these guys do not stop. Pedophiles cannot and do not stop until they are put in prison and made to stop.
Noaker says Gaffany is incredibly brave for sharing his story and opening the first case against Rose here in Fargo. Noaker says he's spoken to at least two other victims, who may not be willing to identify themselves.
The Diocese of Fargo responded to the lawsuit. A written statement was handed to members of the media and read by Monsignor Joseph Goering. The Diocese says it requests reports of suspected incidents of child and sexual abuse.
It welcomes the opportunity to visit with the person and provide what they call "compassionate and pastoral outreach". They would not say if they had met with David Gaffaney, the man at the center of the abuse charges against Brother Raimond Rose.
“We regret that the plaintiff in this matter has seen fit to choose to file suit rather than to seek a pastoral resolution.”
The Monsignor did not take questions from the media after he read the statement.
