Minnesota man convicted of murder to get a new trial

Twin Valley, Minn. (WDAY TV) - A Twin Valley, Minnesota man, convicted of murdering his wife, will get a new trial to determine his sentence. Mark Horn was sentenced in December of 2003 to 20-years in prison.

Twin Valley, Minn. (WDAY TV) - A Twin Valley, Minnesota man, convicted of murdering his wife, will get a new trial to determine his sentence.

Mark Horn was sentenced in December of 2003 to 20-years in prison.

The judge cited 3 aggravating factors: he killed his wife colleen with his children in the house; she was vulnerable because her children were present, and horn concealed the body.

A court of appeals ruled a jury, not a judge, must determine aggravating factors.

Jury selection begins Monday in Polk County.
